CUPECOY--Unit Owners at Rainbow Beach Club on Tuesday decried actions by the developer to shut-off certain necessities on the property for what the developer termed as maintenance related. The unit owners called local media to the scene to complain of elevators that were shut down, lights in corridors disconnected and the swimming pool closed among other things.
They classified these actions by Rainbow Beach Club (RBC) as spiteful and in retaliation of a court verdict last Friday, which barred RBC from unilaterally extending a maintenance agreement for the property after said agreement was terminated at the end of December.
According to the property owner, every apartment owner was free to contract a service company for maintenance of hotel facilities as of January 1, 2012 without RBC’s permission or necessary consensus. The unit owners said RBC’s actions on Tuesday came at a time when it knows that a new agreement with a new provider has not yet been finalised. “So this is just childish behaviour,” one owner said.
Attorney for a majority of the owners Jairo Bloem explained that the loss of control over the services at the property means that RBC will be giving up their power base and as such is acting out in a spiteful way after the verdict.
Nevertheless, Bloem said, “we are proceeding fast” to appoint a new service provider, “we are not going to be discouraged,” he said. Negotiations are ongoing with Solutions Accounting and Management NV to be the property’s new service company.
